The .XXX Registry has decided to introduce a new dispute resolution mechanism, the Rapid Evaluation Service (RES). The RES system is intended to provide a swift resolution to situations in which there is an objectively clear case of abuse. It will mainly apply to well-known trademarks and individuals.
A successful complaint results in the domain name registration being suspended. Further, the respondent is only given 10 business days to respond to a complaint, and the final decision will be made within 5 days following the response due date.
Less clear cases will be handled via the UDRP dispute resolution process, that apply for other gTLDs such as .COM.
In short, a UDRP takes approximately 2 months to process, while a domain name subjected to the RES can be disabled in 48 hours.
Owners of regional trademarks who may not be eligible for RES, should consider defensive registrations as their primary preventive measure.
